DirtyLAWndry reader, “Samantha,” is feeling a little offended by the treatment she’s received at Pepper Hamilton.
“Hey Dirty! I’m a temp worker at Pepper. As a temp attorney, I expected to receive the typical “I’m-better-than-you” treatment from Pepper attorneys that I received at other large firms. But, so far, the Pepper attorneys and partners have treated me just like I’m one of them. But, there’s this annoying legal secretary here that refuses to “play nice.” Our cubicles are next to each other, which thankfully is only temporary. There isn’t a phone in my cubicle yet so I have to use her phone. Everything was fine at first. She was very pleasant towards me and asked me about my family and plans. She made sure that I had everything I needed and that I knew where everything was located. However, once she found out that I was a temp worker, everything went downhill. I had to make a phone call and after I hung up the phone, she started complaining that now she couldn’t use the phone because of the “germs.” I thought she was kidding around until she left the cubicle in a huff and returned with a spray bottle and started wiping down everything that I had previously touched. This isn’t even the first phone call that I made for the day on that phone in her presence. I can only assume that she’s prejudiced against temp workers or crazy.”

A former assistant public defender in Albany, Matthew Swedick, was convicted of having sex with a client in return for promising to work harder on her case. He represented Latoya Gorton on drug charges after an April 2007 raid on a home she shared with a boyfriend. Swedick told her he would “work harder, prioritize her case and treat her as a private-paying client if she engaged in sex with him.” He even secretly taped their sex-capades in his office. You can read more at Times Union.

What was he thinking? According to SeattlePI, Former Washington attorney Bruce Hawkins was arrested for a fraudulent debt elimination scheme. He told clients that national banks could not lend credit so consumers did not have to pay their credit card debt. If that wasn’t bad enough, he formed Commercial Arbitration Forum, Inc. (CAFI) to arbitrate cases. He was CAFI’s sole shareholder and sole arbitrator. So, of course, he ruled in favor of his clients providing them with “awards” to use in court to eliminate the debt. After a financial-services corporation obtained a temporary restraining order against CAFI prohibiting him from conducting any more arbitrations in that debtor’s case, Hawkins sold CAFI business to a non-lawyer friend and demanded a percentage of income generated by the business. He never disclosed his financial interests in CAFI or the new business. To view the discipline notice and the additional ethics violations by Bruce Hawkins, click here.

So, do you guys remember Dr. Orly Taitz, Esquire? She’s the lawyer that filed the lawsuit claiming that President Barack Obama didn’t have the authority to deploy a U.S. Army captain to Iraq because he isn’t a United States citizen (to her understanding or maybe delusion). Well, her case has been dismissed according to the ABAJournal. U.S. District Judge Clay Land basically said her complaint was “frivolous” and based on “unsubstantiated, conclusory allegations and conjecture”. Before dismissing the case, Judge Clay Land said, “Unlike in ‘Alice in Wonderland,’ simply saying something is so does not make it so.” LOL! I wonder how much longer she’s going to solicit her clients from the U.S. Military because her fifteen minutes of fame seems to be up. Check out her web solicitation. I’ve been hearing rumors about a possible disbarment. What do you guys think?

Jarriette Richie worked as a legal secretary for Saul Ewing in Washington. She was charged last week in the District’s federal court with fraud for using a law firm’s corporate credit card to pay for a trip to Puerto Rico for her side business - Show N Tell Entertainment. Prosecutors said, Richie charged $46,848 on the card for fraudulent purchases for the trip. She also deposited counterfeit checks totalling $70,000 in her credit union account to make purchases.
Um. If you’re spending that kind of money as a business person, you are definitely expecting a high return on your investment. My dirty radar is telling me that something other than shaking “what yo’ mama gave ya” was going down on this trip to Puerto Rico. Maybe she could have been pretty successful as a P.erson I.nto M.arketing P.rostitutes. I’m just saying.

So, here’s a video of Assemblyman Mike Duvall, a married man, talking about having sex with two female lobbyists.
The censored parts of the video are said to contain Mike Duvall describing the “little eye-patch underwear” worn by one of the women. Then, he refers to the 18 year age gap between them. “Now, you’re getting old, man, I am going to have to trade you in,” he said he told her.
He goes on to talk about a second affair with another woman:
“Cher, Shar, Shar — oh, she is hot. I talked to her yesterday. She goes, ‘So are we finished?’ ” Duvall says, adding that he replied no. He continues: “And I go, ‘You know about the other one, but the other one doesn’t know about you.’ “
On Wednesday, Assemblyman Mike Duvall resigned from his office and posted the following statements on the Mike Duvall State Assembly website:
“I am deeply saddened that my inappropriate comments have become a major distraction for my colleagues in the Assembly, who are working hard on the very serious problems facing our state. I have come to the conclusion that it would not be fair to my family, my constituents or to my friends on both sides of the aisle to remain in office. Therefore, I have decided to resign my office, effective immediately, so that the Assembly can get back to work.”
He also wanted to make sure that everyone knew - probably more importantly his wife - that he didn’t have any affairs:
“I want to make it clear that my decision to resign is in no way an admission that I had an affair or affairs. My offense was engaging in inappropriate story-telling and I regret my language and choice of words. The resulting media coverage was proving to be an unneeded distraction to my colleagues and I resigned in the hope that my decision would allow them to return to the business of the state.”
Hmmm…so he’s admitting to being a liar and fantasizing about younger women. I’d love to hear your comments on this!

Recently, I’ve seen an increase of articles concerning the state of the legal profession. Some people are blaming the current recession for the lack of law jobs, decreased salaries, and disappearing bonuses and benefits. Others feel that the legal profession was already sinking due to outsourcing and poor regulations. Just look at some of the comments that I’ve seen over at the ABAJournal:
“This is the inevitable popping of the legal services bubble. There are simply too many law schools, too many law students, too many lawyers. Time to shut down some low-ranked schools and shrink the class sizes of higher-ranked schools to reflect the new reality.”
“Fewer law students need to expect to get big firm jobs, and law schools need to do a better job managing expectations and recruiting students who have the desire to work in smaller to mid-size firms.”
“I went to a tier 2 school and graduated in the top 1/4 of my class. I would kill for a small firm job or any job for that matter. I am 160K in debt and virtually unemployable. Law schools should do a better job in not falsifying job stats.”
Do you agree with these sentiments? Can the legal profession be saved by restricting access only to Tier 1 graduates?
